Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BuildCrux platform, including the website at buildcrux.com, mobile applications, and all related services (collectively, the “Service”), operated by TackOn LLC (“we,” “our,” or “us”).
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using BuildCrux, you represent that you meet these requirements. If you are using the Service on behalf of a business, you represent that you have the authority to bind that entity to these Terms.
2. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately at support@buildcrux.com if you suspect unauthorized access to your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Subscription Plans and Billing
3.1 30-Day Money-Back Guarantee
New accounts pay the chosen plan's price at signup and receive full access immediately. If you cancel within thirty (30) days of initial purchase, you may request a full refund by emailing support@buildcrux.com. After the 30-day window, subscriptions renew automatically and refunds are not available except as required by law. A refund issued under this guarantee covers the subscription fee only and is conditioned on termination of your subscription: upon issuing a refund, your access to paid features ends and any remaining or previously-allocated AI estimate credits are forfeited. Accounts subject to a refund or payment dispute (chargeback) may be suspended.
3.2 Paid Subscriptions
- BuildCrux offers multiple subscription tiers (Solo, Crew, Office, and Enterprise) with varying features, project limits, team member limits, and AI credit allocations.
- Subscriptions are billed monthly or annually through Stripe. All fees are in US Dollars.
- You authorize us to charge your selected payment method for the recurring subscription fee.

3.3 Upgrades and Downgrades
You may upgrade or downgrade your plan at any time from your dashboard. Upgrades take effect immediately and are prorated for the remainder of the billing cycle. Downgrades take effect at the start of the next billing cycle. Feature access may change when you downgrade.
3.4 Payment Processing Fees
When your clients pay invoices through BuildCrux, a per-transaction processing fee applies. The rate depends on your subscription plan. These fees are separate from your subscription fee and are deducted from each transaction.
3.5 AI Estimate Credits
Each plan includes a monthly allocation of AI estimate credits. Credits are used when you generate AI-powered project estimates. Unused credits do not roll over to the next month. Additional credit packs may be purchased separately. AI estimating features require an active, paid subscription. AI credits have no monetary value, are not redeemable for cash, and are non-transferable. Credits cannot be used while a subscription is in trial, canceled, expired, suspended, past due, or refunded, and any remaining credits are forfeited upon cancellation, suspension, termination, or refund of your subscription.
3.6 AI Estimate Accuracy & Your Responsibility to Verify
AI-generated estimates, takeoffs, and quantities are provided on a best-effort basis as a draft for your review — not a final, guaranteed, or professionally certified bid. Their accuracy depends on the quality of the drawings you upload: vector/CAD PDF drawings (with selectable text) produce the most accurate and repeatable results, while scanned, photographed, or otherwise image-based (raster) plans are supported but yield lower-confidence estimates whose quantities and totals can vary between runs. You are solely responsible for reviewing and verifying all quantities, unit costs, measurements, and scope against the source drawings and actual field conditions before relying on an estimate or submitting a bid. To the fullest extent permitted by law, BuildCrux and TackOn LLC are not liable for any bid, contract, or business decision made from an AI-generated estimate.
3.7 Cancellation and Refunds
- You may cancel your subscription at any time from your account settings.
- Cancellation takes effect at the end of the current billing period. You will retain access until then.
- We do not offer refunds for partial billing periods, except as required by law.
- Upon cancellation, your data will be retained for 30 days to allow for reactivation or export. After 30 days, data may be permanently deleted.
4. Acceptable Use
You agree to use the Service only for lawful business purposes. You may not:
- Use the Service to engage in any illegal, fraudulent, or harmful activity
- Attempt to gain unauthorized access to the Service, other accounts, or our systems
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to transmit malware, viruses, or other harmful code
- Scrape, crawl, or use automated tools to access the Service without our written permission
- Resell, sublicense, or provide the Service to third parties as your own product
- Submit false, misleading, or fraudulent information through the Service
- Interfere with or disrupt the Service or the servers and networks connected to it
5. Your Data
5.1 Ownership
You retain full ownership of all data you submit to the Service, including project information, invoices, contracts, photos, and business records (“Your Data”). We do not claim ownership of Your Data.
5.2 License to Us
By submitting data to the Service, you grant us a limited, non-exclusive license to process, store, and display Your Data solely to provide and improve the Service. This license terminates when you delete Your Data or close your account. Except as described in Section 5.5 (Improving BuildCrux's AI and Services), this license does not include using Your Data to train any AI model.
5.3 Data Export
You may export your data (projects, invoices, expenses, mileage) in CSV format at any time from your dashboard. We are committed to ensuring you can always take your data with you.
5.4 Third-Party AI Processing
When you use an AI estimate, takeoff, or plan-reading feature, the project descriptions and blueprints you upload are sent to our third-party AI infrastructure provider solely to generate your result and return it to you. That provider uses your content only to generate your result. We do not use, and do not permit that provider to use, your submitted content to train that provider's models or any other third-party or external AI model. This is unchanged and does not depend on any setting. Training of TackOn LLC's own BuildCrux Models is a separate matter governed by Section 5.5 and does not involve any third-party AI provider. 5.5 Improving BuildCrux's AI and Services
Separately from the third-party processing in Section 5.4, TackOn LLC develops its own artificial-intelligence and machine-learning models and features (the “BuildCrux Models”). To improve the BuildCrux Models and the Service, and only after de-identifying them, we may use the files you upload to the Service — such as plans, drawings, photos, documents, and receipts. For this purpose we retain the geometric and structural labels our software computes from your files and an internal reference to your already-stored file; a file is de-identified before it is used to train a model. “De-identify” means removing or redacting information that reasonably identifies a person or project before a file is used for this purpose, including, on drawings, the title block, project name, company name, client or owner names, project address, contact details, project numbers, dollar amounts, and preparer or architect identity, and, on photos and documents, faces, names, addresses, and comparable identifying details. Applying to the files you upload and the de-identified copies derived from them, you grant TackOn LLC a limited, non-exclusive, royalty-free license solely to de-identify those files and use the de-identified copies, together with the geometric and structural labels our software computes from them, to train, validate, and improve the BuildCrux Models and the Service. This grants no other rights, does not transfer ownership (Section 5.1 still applies), and never permits us to sell your files or share them with any third party. We will never sell your files, never share or disclose them to any third party or affiliate for that party's own purposes, and never use them to train a third-party or external AI model (see Section 5.4). Your files stay within your workspace and are not pooled with, or exposed to, other customers.
5.6 Your Choice and How to Turn It Off
This use is on by default, but it is your choice. A company owner or admin can turn it off at any time at Settings → AI & Service Improvement, or by emailing privacy@buildcrux.com. When you turn it off, or delete your account, we stop using your files for any new model training and remove your de-identified copies from our training corpus going forward. One honest limitation: a model that has already been trained cannot be “untrained,” so turning it off is forward-looking and does not reverse training already incorporated into a released model version. Turning it on or off has no effect on your subscription, pricing, features, or the estimates you receive. Full details are on our AI Model Training page.
6. Electronic Signatures
BuildCrux provides electronic signature functionality for contracts and change orders. By using this feature:
- You agree that electronic signatures created through the Service are legally binding to the extent permitted by applicable law, including the U.S. Electronic Signatures in Global and National Commerce Act (ESIGN) and the Uniform Electronic Transactions Act (UETA).
- We capture and store an audit trail for each signature, including the signer's name, email address, IP address, and timestamp.
- You are responsible for ensuring that your use of electronic signatures complies with any industry-specific regulations applicable to your business.
- BuildCrux is not a party to any contract signed through the Service and bears no responsibility for the content or enforceability of such contracts.
7. Intellectual Property
The Service, including its design, code, features, logos, and content (excluding Your Data), is owned by TackOn LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
8. Third-Party Services
The Service integrates with third-party services including Stripe (payments), Google Maps (mileage and location), and a third-party AI infrastructure provider (AI estimates). Your use of these integrations is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
9. Disclaimers
- The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
- We do not warrant that the Service will be uninterrupted, error-free, or secure at all times.
- AI-generated estimates are provided as a starting point and should be reviewed by a qualified professional before use. We do not guarantee the accuracy of AI estimates.
- BuildCrux is not a law firm, accounting firm, or financial advisor. Features like invoicing, expense tracking, and mileage reports are tools to help you manage your business but are not substitutes for professional advice.
10. Limitation of Liability
To the maximum extent permitted by law, TackOn LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of or inability to use the Service.
Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the total amount you paid us in subscription fees during the twelve (12) months immediately preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless TackOn LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
- You may close your account at any time by contacting support.
- We may suspend or terminate your access to the Service at any time if you violate these Terms, engage in prohibited conduct, or fail to pay subscription fees.
- Upon termination, your right to access the Service ceases immediately. We will retain Your Data for 30 days following termination to allow for data export, after which it may be permanently deleted.
- Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Texas. You agree to waive any right to a jury trial or to participate in a class action.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will post the revised Terms on this page and update the “Last updated” date. For significant changes, we may also notify you by email. Your continued use of the Service after the updated Terms are posted constitutes acceptance of the new Terms.

Program Name: TackOn LLC SMS Communications.
Program Description:BuildCrux is a product of TackOn LLC. TackOn LLC sends SMS to people who opt in, in connection with their own requests, appointments, account, and the products they use (BuildCrux, TackOn FSM, TackOn Table, and TackOn Connect). Message categories include demo scheduling, appointment reminders, trial onboarding, customer support, account notifications, service notifications, and follow-up communications related to a user’s request. The program does not send OTP / 2FA codes.
How you opt in: Sign in to your BuildCrux account at https://buildcrux.com/dashboard/settings and, under Business Info → Phone, enter your mobile number AND manually select the unchecked SMS consent checkbox. The phone field is optional. SMS consent is never required to create or keep your BuildCrux account. The consent timestamp is recorded as workspaces.sms_consented_at on the server as the consent evidence we retain. A public screenshot of the checkbox and verbatim disclosure language is hosted at https://buildcrux.com/sms-consent.
